

Prosecution Of A Trademark Application In Uruguay
FILING
The filing date of a Uruguayan trademark is the one assigned when filing the application.
If priority is claimed, the filing date will remain the same but the priority date will be the one claimed.
FORMAL EXAMINATION
Within 30 to 60 days from the filing date
The Uruguayan Trademark Office will determine within 30 – 60 days if the application meets the formal requirements and if it does, the trademark will proceed to publication.
PUBLICATION
Within 30 days from the formal examination
When the Trademark Office deems the application meets the formal requirements, it will order the publication in the official” Bulletin of Industrial Property” within the next 30 – 60 days.
OPPOSITION PERIOD
Day after publication + 30 days
The opposition period starts the day after the trademark is published and ends 30 days later.
SUBSTANTIVE EXAMINATION
Approximately 2 years
During this phase, the Trademark Office will analyze the application on both absolute and relative grounds of refusal. This includes a search to determine potential legal obstacles.
GRANTING
Within 20 to 24 months from the filing date
If no obstacles are found, the Trademark Office will proceed to grant the trademark.
The mark will be protected for a period of 10 years, counting from the granting date.
CERTIFICATE OF REGISTRATION
2 months counted from payment of the registration certificate fees
After the registration certificate fees are paid, an electronic certificate is issued within 2 months.
Useful Information
As of 1 January 2019 cancellation can be requested if a trade mark has not been used for 5 years, counting from the registration date.
Partial cancellation is not possible.
