SPTO grants for the promotion of Patent and Utility Model applications (Spanish and abroad) and EUIPO subsidies for the protection of Industrial Property rights.

(TODAY, Madrid)

(I)  On April 18, 2024, the SPTO published in the Official State Gazette the resolution of the SPTO for the call of subsidies for the promotion of Spanish and foreign Patent and Utility Model applications.

The aim is to promote the international protection of technology through patents in order to improve the competitiveness of companies, especially small and medium-sized enterprises (SMEs).

The deadline for submitting applications is May 20, 2024. The processing of the subsidies must be carried out entirely electronically before the SPTO.

In short, Patent and/or Utility Model applications that can benefit from these subsidies must have been filed abroad claiming priority of a Patent Application, Utility Model, PCT international application or European Patent application filed before the SPTO. The activities to be subsidized are those whose expenses have been incurred between January 1, 2023 and December 31, 2023.

Likewise, Spanish Patent and Utility Model applications that do not claim priority and have been published during the years 2021, 2022 and 2023 and have not received a grant in previous calls will be subsidized.

(II) On the other hand, small and medium-sized companies established in the European Union may benefit from the grant program called by the EUIPO that allows them to access a partial reimbursement of the fees paid to protect their Industrial Property rights and, in particular, for Trademarks and Designs (up to 1,000 €), for Patents (up to 3,500 €) and for Plant Varieties (up to 1,500 €).
