Patent prosecution changes already applicable in Argentina by virtue of Decree 27/2018

Following recent publication of Decree Nº 27/2018 regulating some aspects for prosecution of patents, trademarks and designs, the Argentinean Trademark and Patent Office has issued Notice P-001/2018 dated January 16, 2018 stating those changes applicable from now on.

In short, the most relevant changes concerning patents would be the following:

  • Submission of certified priority documents along with the corresponding Spanish translations are no longer required unless specifically requested during examination.

  • The term to request substantive examination has been reduced from 36 months to 18 months as of filing date. In case of pending applications, the deadline will be the earlier of 36 months from the filing date or July 12, 2019 (18 months from the date of entry into force of Decree 27/2018. Changes regarding trademarks and designs are still pending specific regulation in order to be applicable.
