Patent subsidies for patent application will be no longer available in China as of June 2021

On January 27, 2021, the China National Intellectual Property Administration (CNIPA) issued a Notice informing that all kinds of public financial subsidies in support of patent applications will be no longer available as of June 2021; likewise, the benefits of subsidies for granted patents are being significantly reduced and will finally be abolished before 2025.

The aim for such restrictive measures is to reduce the huge number of patent applications which are being filed merely with the purpose of obtaining public financial support, thus generating a significant backlog of work at the CNIPA. Even though enforcement of this measure is still somewhat uncertain since it would need to be confirmed by the State Council of China in order to control all different local authorities currently granting financial support for patent applicants, different administrative sanctions are already being considered by CNIPA for those applicants which continue filing applications merely to obtain financial subsidies.

On the other hand, we take this opportunity to mention that the CNIPA has also published amendments to Patent Examination Guidelines, mainly focused on pharmaceutical and biotech patent applications, applicable as of January 15, 2021.
