New formal requirement for patent applications filed in Argentina claiming foreign priority rights.

As you may recall, following publication of the Legal Decret No. 27/18 by the Argentinean Patent Office on January 12, 2018, it was is no longer necessary to submit certified copy of the priority application along with its Spanish translation when filing a patent application.

However, after issuance of Resolution No. 250/2018 on September 27, 2018, submission of the sworn Spanish translation (certified by a local registered translator) of the priority application is compulsory again within a 90 days term from filing. Certified copy of the priority application shall not be necessary unless explicitly requested by the examiner in charge.

This requirement is also applicable for all those patent applications filed as of January 12, 2018 for which translation of the priority application must be submitted by December 30, 2018.
