Update on the measures proposed by the Brazilian Patent Office in order to reduce the backlog of patent applications.

We recently informed on the implementation by the Brazilian Patent Office of Rule No. 193/2017 in order to expedite examination of patent applications making use of search reports issued by International Search Authorities (ISA) and International Preliminary Examining Authorities (IPEA).

However, the Brazilian Patent Office has officially revoked said Rule and has opened a public consultation on the proposal of a new simplified allowance procedure for pending patent applications, which would be granted without technical examination provided that certain requirements are met.

Still pending approval (interested parties may provide comments until August 21, 2017), we draw your attention to the fact that said simplified procedure of grant would only apply to applications filed prior to the date of entry into force of same, so that it may be advisable to speed up your patent filings in case that you wish to benefit from this procedure (if finally adopted).
