Earlier this week BALDER partner Magnus Stiebe gave a lecture at the University of Barcelona, within the framework of the so-called “Patent Mondays“, one of the major events for continued professional education for patent professionals in Spain. The topic was the interaction between art. 14(2) EPC (allowing for the correction of the translation into the language of the proceedings of an application filed in a non-EPO language) and art. 123(3) EPC. Based on a recent (and so far successful) opposition case, Magnus showed how a somewhat sub-optimal translation (maybe the result of sub-optimal claim drafting) can lead the patentee into an unescapable trap.
