Brazilian Trademark Office expected to reduce its backlog with resolution No. 206/2017

As of January 25th., 2018, the Brazilian Trademark Office’s Resolution No. 206/2017, entered into force with the ultimate purpose of expediting the examination of trademark applications and overcome the current backlog.

Through this new resolution, any information provided by the applicant in the relevant application form will be interpreted as true, though requisites on the applicant’s legitimacy may be randomly verified. In fact, only if there is a suspicion on the veracity of information provided by the applicant, will the Trademark Office raise an office action.

Even though foreign applicants may not be directly affected by this change, it is expected that the time for the formal examination shall be considerably reduced, thereby anticipating the substantial examination.
